Acceptance of the conditions of sale:
The customer acknowledges having read, at the time of placing the order, the special conditions of sale stated on this screen, and expressly declares to accept them without reservation.
The present general conditions of sale govern the contractual relations between Philippe Poulard, Le Fer Savoir and his customer, both parties accepting them without reserve.
These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation.

Products
The photographs illustrating the products, in particular the covers of books, do not enter the contractual field.
If errors are made, Philippe Poulard, Le Fer Savoir cannot be held responsible.
The majority of the products offered to its customers by Philippe Poulard, Le Fer Savoir are available in our warehouse, unless otherwise clearly indicated.

Orders
The automatic registration systems are considered as proof of the nature, content and date of the order.
Philippe Poulard, Le Fer Savoir confirms the acceptance of the order to the customer at the email address that the latter will have communicated.
The sale will be concluded only after the confirmation of the order and the payment.
Philippe Poulard, Le Fer Savoir reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order.
The information given by the buyer when placing an order is binding on the buyer: in case of error in the address and phone number of the recipient, the seller cannot be held responsible for the impossibility of delivering the product.

Delivery
After confirmation of the order, Philippe Poulard, Le Fer Savoir undertakes to deliver to its carrier all the references ordered by the buyer within a maximum of 72 working hours.
This carrier commits to deliver the order to the buyer’s address provided by Philippe Poulard, Le Fer Savoir.
Furthermore, for deliveries outside of metropolitan France, the customer agrees to pay all taxes due on the import of products, customs duty, value added tax, and all other taxes due under the laws of the country where the order is received.
Philippe Poulard, Le Fer Savoir will not be held responsible for the payment of any taxes due by the customer.
The delivery will be made either by Colissimo or by Mondial Relay in Metropolitan France. Possible delays do not give the right to the buyer to claim damages.
In the case of a technical product, the customer will be particularly careful to check the proper functioning of the device delivered, to read the instructions provided.
In case of apparent defects, the buyer has the right to return the product under the conditions provided in this document.
War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging the seller from his obligation to deliver.
The goods always travel at the risk of the recipient.
Always check your package upon arrival.
You have 48 hours to make any reservations with the carrier in case of missing or damaged goods.
For reasons of availability, an order can be delivered in several times to the customer.
If the customer wishes 2 places of delivery, he places 2 orders.

Withdrawal
You have 7 days (as from the reception of the articles) to make you an opinion.
In case of exchange or refund, send the article(s) back in its (their) original packaging, undamaged, with all the possible accessories, instructions and documentation to the following address

In case of exercising the right of withdrawal, Philippe Poulard, Le Fer Savoir is obliged to reimburse the sums paid by the customer, free of charge, with the exception of the return postage.
The refund is due within a maximum of 21 days.

Price
The price is expressed in Euro.
The price indicated on the product sheets includes delivery.
The price indicated in the order confirmation is the final price, expressed all taxes included, and including the VAT for France and the countries of the EEC.
This price includes the price of the products, the handling, packaging and storage costs of the products, and the transport costs.

Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by Philippe Poulard, Le Fer Savoir.
The price of the products is payable in cash on the day of the effective order.
The payment is made by the various possibilities proposed on the site.
Philippe Poulard, Le Fer Savoir reserves the right to refuse any order from a customer with whom a dispute exists.

Litigation
The present contract is subject to French law.
Philippe Poulard, Le Fer Savoir cannot be held responsible for any damages of any kind, whether material or immaterial or physical, which may result from the improper functioning or use of the products sold.
The same applies to any modifications of the products by the manufacturers.
The liability of Philippe Poulard, Le Fer Savoir shall in any case be limited to the amount of the order and shall not be held responsible for simple errors or omissions that may have occurred despite all precautions taken in the presentation of the products.
In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution in particular with the assistance of a professional association of the branch, an association of consumers or any other council of his choice.
It is reminded that the search for an amicable solution does not interrupt the “short period” of the legal guarantee, nor the duration of the contractual guarantee.
It is reminded that as a general rule and subject to the appreciation of the courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the purchaser honors his financial commitments towards the seller.
Complaints or disputes will always be received with attentive benevolence.
Good faith is always presumed in those who take the trouble to expose their situations.
In the event of a dispute, the customer will first contact the company to obtain an amicable solution.
Failing that, the Commercial Court is the only competent court, whatever the place of delivery and the method of payment accepted.

Guarantee
In all cases Philippe Poulard, Le Fer Savoir cannot be held responsible for
for non-compliance with the regulations and legislation in force in the country of reception.
The liability of Philippe Poulard, Le Fer Savoir is systematically limited to the value of the product in question, value at the date of sale, without any possibility of recourse against the brand or the company producing the product.
In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code).
On the condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the Civil Code).
If the buyer goes to court, he must do so within a short period of time from the discovery of the hidden defect (art.1648 of the civil code).
Legal information
The information collected for the purposes of distance selling is mandatory.
This information is essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee.
The lack of information leads to the non-validation of the order.
The customer has the right to access, modify, rectify and delete data concerning him/her, which he/she can exercise by contacting Philippe Poulard. Le Fer Savoir commits itself not to communicate, free of charge or in exchange, the contact information of its customers to a third party.
